WhereasbytheXthArticleoftheTreatybetweenHerMajestytheQueenoftheUnitedKingdomofGreatBritainandIreland,andHisMajestytheEmperorofChina,concludedandsignedonboardHerBritannicMajesty'sshipCornwallis,atNanking,onthe29thdayofAugust,1842....itisstipulatedandagreed,thatHisMajestytheEmperorofChinashallestablishatalltheportswhich,bythe2ndArticleofthesaidTreaty,aretobethrownopenfortheresortofBritishmerchants,afairandregulartariffofexportandimportcustomsandotherdues,whichtariffshallbepubliclynotifiedandpromulgatedforgeneralinformationandfurther,thatwhenBritishmerchandiseshallhaveoncepaid,atanyofthesaidports,theregulatedcustomsanddues,agreeabletothetarifftobehereafterfixed,suchmerchandisemaybeconveyedbyChinesemerchantstoanyprovinceorcityintheinterioroftheEmpireofChina,onpayingafurtheramountofdutyastransitduty AndwhereastherateoftransitdutytobesoleviedwasnotfixedbythesaidTreatyNow,therefore,theundersignedPlenipotentiariesofHerBritannicMajesty,andofHisMajestytheEmperorofChina,dohereby,onproceedingtotheexchangeoftheRatificationsofthesaidTreaty,agreeanddeclare,thatthefurtheramountofdutytobesoleviedonBritishmerchandise,astransitduty,shallnotexceedthepresentrates,whichareuponamoderatescaleandtheRatificationsofthesaidTreatyareexchangedsubjecttotheexpressdeclarationandstipulationhereincontained.InwitnesswhereoftherespectivePlenipotentiarieshavesignedthepresentdeclaration,andhaveaffixedtheretotheirrespectiveseals.
